Mckenzie Friend
The concept of a McKenzie friend comes from the English case of McKenzie v McKenzie [1970] 1 P 33 where the court decided that:
“Any person, whether he be a professional man or not, may attend as a friend of either party, may take notes, quietly make suggestions, and give advice; but no one can demand to take part in the proceedings as an advocate, contrary to the regulations of the court as settled by the discretion of the justices.”

Alternative Dispute Resolution
It is important that your business relationships are conducted on the most amicable basis possible. It is in this spirit that I always encourage clients to engage in informal negotiations to resolve any issues that may arise when conducting business.
The judicial system in the United Kingdom looks kindly upon those that use the court system as a last resort. Thus using Alternative dispute resolution is the best way for issues to be resolved on a non-adversarial platform. Part 36 of the Civil Procedure Rules says that where ADR is engaged at the outset it will go towards determining costs awarded in proceedings.
Common forms of ADR that I am involved in are:
- mediation, where an independent third party helps the disputing parties to come to a mutually acceptable outcome
- arbitration, where an independent third party considers the facts and takes a decision that’s often binding on one or both parties
